The Most Common Reasons People Don’t Pursue Medical Malpractice Claims

On Behalf of | Apr 25, 2016 | Medical Malpractice

Have you ever heard someone describe a horrible medical situation and wondered, “Why didn’t they sue?” From negligence to defective medical devices to adverse side effects from medication, so much can go wrong if a doctor isn’t giving you their full attention or isn’t listening to your concerns. So why isn’t it more common for

individuals to hold their health care professionals responsible?

One study in Massachusetts found that 58 percent ofmedical malpractice claims brought were abandoned. The study found that dropped cases-not “frivolous claims”-were actually the number one money drain on the system, as they imposed great costs to both sides but recovered no benefit for either party.

There are three main reasons that injured individuals don’t pursue a claim of medical malpractice:

  1. They fear the doctor or hospital will learn of their claim and refuse to treat them. When you are injured due to a doctor’s negligence or a defective medical treatment, your health problems are usually just beginning. You will need the knowledge and support of your medical providers. Many patients fear that their doctors will turn them away or give them less than competent medical care if they bring a claim of injury.
  2. They fear their medical expenses will increase. Medical insurance is not like car insurance, and bringing a medical malpractice claim does not make you a greater risk for your insurance company to insure.
  3. They fear the personal and financial costs will be too great. Unfortunately, as a victim of medical malpractice, you have already paid the greatest price-your health. A strong case with an experienced medical malpractice attorney can help you recover for your losses and get you back to health without having the process last longer or cost more than it has to.
