Rights of Passengers in Automobile Accidents

Passengers who are injured in a car accident have rights and can sometimes recover for their injuries. Passengers should be informed of what their rights are. They should also be aware of who they can bring a cause of action against to recover for their injuries.

A passenger who is injured in a car accident should be aware that he can and should file a claim under the car insurance of the owner of the car the passenger was in. Sometimes the owner will be someone different from who was driving the car at the time of the accident. This is especially important for the passenger to do if it was a one-car accident. But, no matter how many cars were involved, the passenger should do this.

A passenger should also file claims against the insurance of the owner of any other vehicles that were involved in the accident. Sometimes this will be only one other vehicle, but it is important to know that it could be several accidents. The passenger should make sure that he gets all of the insurance information for all of the owners of all the other vehicles involved.

It is also important for the passenger to know that he will not recover any more than the total amount for his injuries even though he is filing claims against multiple people. Filing the claims helps the passenger to recover money for the injuries he sustained. It gives the passenger options about who he can collect from. So, if one of the vehicles does not have enough insurance to cover the injuries, the passenger may try to collect the remaining money from another claim he filed.
